1. Acceptance of Terms

By accessing and using PolarisVex's lead generation platform and services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

PolarisVex provides AI-powered lead generation and digital marketing services designed to help businesses identify, target, and engage with potential customers across multiple channels including email, social media, and online advertising platforms.

3. User Accounts and Registration

To access certain features of our service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

3.1 Account Security

You are responsible for safeguarding the password and for maintaining the confidentiality of your account. You agree not to disclose your password to any third party and to take sole responsibility for any activities or actions under your account.

4. Pricing and Payment Terms

PolarisVex operates on a pay-per-response model where clients are charged only for leads that respond to outreach campaigns with meaningful engagement.

4.1 Pricing Structure

  • Starter Plan: $30 per replied lead
  • Professional Plan: $50 per replied lead
  • Scale Plan: $75 per replied lead
  • Enterprise Plan: $100 per replied lead (custom pricing available)

4.2 Payment Terms

Payment is due within 30 days of invoice date. Late payments may result in service suspension. All fees are non-refundable except as expressly stated in these terms.

5. Acceptable Use Policy

You agree to use PolarisVex services only for lawful purposes and in accordance with these Terms of Service.

5.1 Prohibited Activities

You may not use our services to:

  • Send spam or unsolicited communications
  • Violate any applicable laws or regulations
  • Infringe upon intellectual property rights
  • Engage in fraudulent or deceptive practices
  • Harass, abuse, or harm others
  • Distribute malware or harmful content

6. Data Privacy and Protection

PolarisVex is committed to protecting your privacy and the privacy of your prospects. Our data handling practices are governed by our Privacy Policy, which is incorporated by reference into these Terms.

6.1 Data Compliance

We maintain compliance with applicable data protection regulations including GDPR, CCPA, and other relevant privacy laws. All prospect data is handled in accordance with these regulations and industry best practices.

7. Intellectual Property Rights

The PolarisVex platform, including all software, algorithms, designs, and content, is protected by intellectual property laws. You are granted a limited, non-exclusive license to use our services in accordance with these terms.

8. Service Availability and Modifications

We strive to maintain high service availability but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any aspect of our services with reasonable notice.

8.1 Maintenance and Updates

Scheduled maintenance will be communicated in advance when possible. Emergency maintenance may occur without prior notice to ensure service security and stability.

9. Limitation of Liability

To the maximum extent permitted by law, PolarisVex shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

10. Indemnification

You agree to defend, indemnify, and hold harmless PolarisVex and its affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of our services or violation of these terms.

11. Termination

Either party may terminate this agreement at any time with 30 days written notice. PolarisVex may terminate immediately for breach of these terms or illegal activity.

11.1 Effect of Termination

Upon termination, your access to services will cease, and any outstanding fees become immediately due. Data retention and deletion will be handled according to our Privacy Policy.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.

12.1 Dispute Resolution Process

Any disputes arising under these terms shall first be addressed through good faith negotiations. If unresolved, disputes may be submitted to binding arbitration in accordance with the rules of the American Arbitration Association.

13. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Material changes will be communicated via email or platform notification at least 30 days before taking effect.

15. Severability

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and PolarisVex regarding the use of our services and supersede all prior agreements and understandings.
